Welcome to CURE Curriculum (“CURE,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our curriculum, platform, website, content, tools, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Services.

1. Eligibility

By using our Services, you affirm that:

• You are at least 18 years old, or
  
  

• You are a teacher, administrator, parent, or legal guardian using the Services on behalf of a student under the age of 18 and have obtained necessary consents.
  
  

If you are accessing CURE Curriculum as part of a school or district, you represent that you have the authority to bind that institution to these Terms.

2. Use of Services

You agree to use the Services only for lawful, educational, and non-commercial purposes in accordance with these Terms.

You may not:

• Use the Services for any purpose not expressly authorized by us
  
  

• Copy, distribute, modify, or create derivative works without permission
  
  

• Reverse-engineer or attempt to extract the source code
  
  

• Interfere with the proper functioning of the platform
  

3. Accounts and Access

Educators, schools, or institutions may create accounts to access the curriculum. You are responsible for maintaining the confidentiality of login credentials and ensuring that all activity under your account complies with these Terms.

If you suspect unauthorized access, notify us immediately.

4. Student Data and Privacy

We take privacy seriously. Our collection and use of data is governed by our Privacy Policy. When using our Services on behalf of students, you agree to comply with applicable student data protection laws, including:

• FERPA (Family Educational Rights and Privacy Act)
  
  

• COPPA (Children’s Online Privacy Protection Act), when applicable
  
  

• Any other local, state, or international regulations
  
  

We do not use student data for marketing or advertising purposes.

5. Intellectual Property

All content, curriculum materials, software, and trademarks provided through the Services are owned by or licensed to CURE Curriculum and are protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services for educational purposes only. You may not use any part of the Services for commercial purposes without our written consent.

6. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice. We are not liable for any interruption, delay, or inability to access the Services.

We may also update these Terms periodically. Continued use of the Services after changes are posted means you accept the new Terms.

7. Termination

We may suspend or terminate your access to the Services at any time, without notice, if you violate these Terms or use the Services in a way that could cause harm or liability to us or others.

Upon termination, all licenses granted to you under these Terms will immediately end.

8. Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Services will be error-free, uninterrupted, or meet your expectations.

To the fullest extent permitted by law, CURE Curriculum shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services.

9. Indemnification

You agree to indemnify and hold harmless CURE Curriculum, its affiliates, officers, and employees from any claims, losses, damages, or expenses (including legal fees) arising out of your violation of these Terms or misuse of the Services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Illinois, without regard to conflict of law principles.

Any disputes will be resolved in the courts of Winnebago County, Illinois.
